How to establish paternity

If you are preparing for a divorce in Ohio and were not married to your spouse at the time your children were born, you may be concerned about whether or not you will need to establish paternity. One of the easiest ways to establish paternity occurs before you ever leave the hospital. According to the Ohio State Bar Association, if you and the child’s mother acknowledge under oath that you are the father, you will be able to sign the “brown form” and establish paternity. If your child was born after January 1, 1998, but you only signed the birth certificate, you will still need to verify paternity. If you neglected to do either at birth, there are still options for establishing that you are the father.


In many cases, you will need to have DNA testing done. Doing this as quickly as possible can prove to the court your desire to gain custody. It can also protect you if your paternity is challenged at any time during the court case.
