What are some unique challenges of same-sex divorce?

Ohio legalized same-sex marriage in 2015, which represented a huge step forward for the LGBTQ+ community. However, with this ruling comes an increase in the number of divorces by same-sex couples. These divorces are in many ways very similar to those filed by straight couples, but they do come with some factors that require different considerations.

What are some of the unique challenges of same-sex divorce in Ohio?

Getting enough emotional support

Divorce is difficult for nearly all couples, even those who part amicably, regardless of sexual orientation or any other factor. However, as members of a minority group, many same-sex couples going through a divorce need to take extra care to ensure that they surround themselves with supportive people during this trying time. Support groups can be a good option for anyone going through a difficult time and needing to connect with others who can relate.

Divvying up assets

The length of a marriage plays into many parts of a divorce, including how to divide property and how much support one former spouse should provide the other. Many gay and lesbian couples who got married in 2015 and after had been together for many years prior to that, with some receiving civil unions in states where that was an option. This can complicate legal issues where the length of the marriage is a consideration.

All divorce cases are different, including same-sex divorce cases. Those who are going through a divorce should be aware of the unique challenges that they may encounter as they begin the separation process.
