Growing your family through stepparent adoption

Adoption is a beautiful way for your Ohio family to expand and grow, and sometimes, this means formalizing meaningful relationships you already have in your family. In some situations, stepparents may be able to adopt their stepchildren. If you would like to adopt the children of your partner and legally establish your role as a parent, you may find it beneficial to first learn how this process will work.

While not as complicated as other types of adoption, it can beneficial to have guidance as you navigate this process. There are certain sensitive issues to address, such as termination of parental rights. Stepparents play an important role in the lives of their stepchildren, and adoption may be a beneficial step for your unique family situation.

What's so hard about stepparent adoption?

It may seem like a completely natural step to adopt the children you love and are raising as your own. However, the children do have another biological parent, and he or she has parental rights to consider. In order for a stepparent to adopt stepchildren, there must first be a termination of parental rights. It may be helpful to consider the following: 

  • You will have to obtain consent from the other parent before adopting a stepchild, which is complete relinquishment of all of his or her parental rights.
  • If the other parent refuses to consent yet is not truly present in the life of the child or is unfit, a court may grant a termination of parental rights.
  • If the other parent is not present to grant consent, a court may allow you to move forward by granting a termination of the rights of that parent.

The termination of parental rights is the often the most complex and sensitive aspect of stepparent adoption. Before you initiate this process, it may be helpful to seek an assessment of your situation and find out how what options are available to you
